Jokowi Signs Village Law, Village Heads Can Retire and Serve for a Maximum of 16 Years

JAKARTA – President Joko Widodo (Jokowi) officially signed Village Law . In this law, the village head (Kades) will receive post-service or retirement benefits and can serve for a maximum of 16 years.

Pension benefits are regulated in Law Number 3 of 2024 concerning the second amendment to Law Number 6 of 2014 concerning Villages.

“Get retirement allowance 1 (one) time at the end of the term of office according to the village’s financial capacity as regulated in the Government Regulation,” reads Article 26 paragraph 3 letter d of the regulation, quoted Thursday (2/5/2024).

It is explained that what is meant by post-service allowance is a legal receipt as a reward for the Village Head who has completed carrying out his position in the form of money or the equivalent.

In this law, the Village Head also has the right to receive a fixed monthly income, allowances and other legal income, as well as receive social security in the fields of health and employment.

Article 26 paragraph 3:

In carrying out the duties as intended in paragraph (1), the Village Head has the right to:
a. Proposing the organizational structure and work procedures of the Village Government;
b. Submitting drafts and establishing Village regulations;
c. Receive a fixed monthly income, allowances and other legal receipts, as well as social security in the fields of health and employment;
d. Receive retirement allowance 1 (one) time at the end of the term of office according to the village’s financial capacity as regulated in Government Regulation;
e. Obtain legal protection for the policies implemented; And
f. Provide mandates for the implementation of duties and other obligations to Village officials.

In this law, several article provisions were changed. One of them is Article 39 related to the maximum term of office of the Village Head which is only 8 years and can only serve twice for two terms.

Article 39:

(1) The Village Head holds office for 8 years starting from the date of inauguration.
(2) The Village Head as intended in paragraph (1) can serve a maximum of 2 consecutive or non-consecutive terms of office.
