The hearing of the case filed in India against Prashant Kumar Halder alias PK Halder for allegedly embezzling and smuggling tens of thousands of crores of rupees from Bangladesh has been postponed again. Kolkata’s City Sessions Court ordered him to appear in court again on February 28.

Earlier, last Saturday (February 17) when the case came up in the Kolkata City Sessions Court, the court fixed February 20 as the hearing date. However, on Tuesday, instead of the bench of Special Court-3 Judge Subhendu Sahar of Calcutta City Sessions Court, the case was taken up in the bench of Special CBI Court-1 Judge Prasanna Mukherjee.

The accused were brought to the court at around 12 noon local time on this day. Judge Prasanna Mukherjee took them to the bench at 12:30 pm. After hearing the arguments of the lawyers of both sides, the judge fixed the date of the next appearance of the case.

Pranesh Kumar Halder has been applied for bail in this case. Besides, an application has been made to the court seeking the medical report of another accused Amana Sultan. Besides, an application has been made to restore PK Halder’s residence in Vedic Village, Kolkata and keep his ailing mother Lilavati Halder there. A hearing on these matters may be held on February 28.

Orjit Chakraborty, lawyer for the Enforcement Directorate (ED), said two petitions were filed on behalf of the accused. They had a hearing today. But an application was made for a stay on that hearing. The court allowed it. The next hearing will be held on February 28.

In response to the question of what is going to happen in the legal aspect of this case in the coming days, the ED lawyer said that the evidence has not yet started. Let the trial begin first. A copy of the sentence handed down in Bangladesh has not reached the court. As far as we know, the sentencing has been announced, but the sentencing has not yet been completed. Until the transcript of that judgment comes, there is some hindrance in proceeding with the proceedings here.

Arjit Chakraborty said about taking the rest of the accused including PK Halder to Bangladesh, it should not be said that the process of taking them to Bangladesh is too long and this is not the time to say so.

It is to be noted that on May 14, 2022, the Enforcement Directorate of India’s central investigative agency arrested PK Halder, the former managing director of Bangladesh-based Global Islami Bank (formerly NRB Global) in raids in several places in West Bengal.

His brother Pranesh Halder, Swapan Mistry alias Swapan Maitra, Uttam Mistry alias Uttam Maitra, Imam Hossain alias Eamon Halder and Amana Sultana alias Sharmi Halder along with the rest of the accused were also arrested.

On July 11, the ED submitted the charge sheet against the accused in the Kolkata court. Charges were framed against the six accused in India’s ‘Money Laundering Act-2002’ and Anti-Corruption Act-1988 case.

Presently five male accused along with accused PK Halder are in Presidency Jail while only one female accused is in Alipore Central Jail.
