SPÖ “animal protection spokesman” fails again with an interim injunction / OLG classifies scenes in the video as violations of the Animal Protection Act
Lochen/Ried/Carinthia/Linz (OTS) – The application for an interim injunction by the ÖHV (dog sports association) as the organizer of the Carinthian “Dog Biting World Cup” against the criticism of the Pfotenhilfe association (see was rejected by the Ried regional court in December (see The ÖHV with its chairman, event manager and SPÖ “animal protection spokesman” Dietmar Keck fought this by means of an appeal. Now the Linz Higher Regional Court has also rejected him and also sees full responsibility for the incidents on the organizer.
The Linz Higher Regional Court shares the opinion of the Ried Regional Court, according to which it considered that the scenes shown in the published video were violations of the Animal Welfare Act and that an average viewer could classify these scenes as violations and the allegations based on a true, at least sufficiently certified core of facts. According to the OLG decision, the costs of 1,335.50 euros must be reimbursed to Pfotenhilfe.
Meanwhile, the proceedings continue to drag on and there is not even a hearing date for the lawsuit itself. “The fact that an animal protection spokesman is fighting animal protection is – to say the least – strange. This SLAPP lawsuit, which is intended to silence us, also restricts our daily animal protection work,” says Pfotenhilfe spokesman Jürgen Stadler. “It is really sad that in Austria, once again, animal rights activists who expose grievances are persecuted and have to prove themselves free, while animal abusers get off far too mildly or scot-free.”
In the meantime, the government has finally agreed on a long overdue amendment to the protection of pets, which is intended to further restrict such bite training and thus reduce biting incidents. However, details must first be worked out and put into regulations. And all of this before the National Council election.
