Michigan court rejects attempt to disqualify Trump for 2024 elections

The Michigan Supreme Court on Wednesday rejected a petition seeking to prevent former US President Donald Trump from running for president for allegedly supporting an “insurrection.” The lawsuit was dismissed early in the process and never went to trial. The Michigan Court of Appeals also upheld the decision to dismiss this case.

Additionally, both courts rejected the case solely on procedural grounds and have stopped short of considering whether an insurrection took place during the January 6, 2021, assault on the Capitol or whether Trump participated in it.

On the other hand, on December 20, the Colorado Supreme Court prohibited the former president from running in next year’s primaries in that state, citing constitutional reasons. It is worth mentioning that this ruling was suspended pending an appeal. At the same time, more than a dozen other U.S. subnational entities have pending legal cases challenging Trump’s plans to participate in the Republican primary in a few months.
Insurrection clause

Former US President Donald Trump could be banned from the next presidential election if his opponents manage to demonstrate that the politician may be subject to a rarely used clause in the US Constitution targeting candidates who have supported an “insurrection.” ». In that case, Trump would be disqualified from ever occupying the White House again due to his alleged attempts to undermine the 2020 election and the role he played in the assault on the Capitol on January 6, 2021.

The clause, of the 14th Amendment, stipulates that anyone who “engages in insurrection or rebellion” after taking an oath to defend the Constitution is prohibited from holding any public office. The 14th Amendment was written after the Civil War and the clause was intended to prevent southern states from electing former Confederate officials to Congress. With RT
