According to the provisions of Clause 1, Article 100 of the 2013 Land Law, households and individuals that are using land stably and have one of the following documents will be issued a red book and do not have to pay land use fees. Can:

– Documents on land use rights before October 15, 1993 issued by competent authorities during the implementation of land policies of the State of the Democratic Republic of Vietnam and the Provisional Revolutionary Government of the Central Republic of Vietnam. South Vietnam and the State of the Socialist Republic of Vietnam.

– Temporary land use rights certificate issued by a competent state agency or listed in the land registration book or cadastral book before October 15, 1993.

– Legal documents on inheritance or donation of land use rights or assets attached to land; Papers for handing over charity houses and charity houses attached to land.

– Documents transferring land use rights, buying and selling houses attached to residential land before October 15, 1993, certified by the Commune People’s Committee as being used before October 15, 1993.

– Documents for liquidation and valuation of housing attached to residential land; Documents to buy state-owned housing according to the provisions of Law.

– Documents on land use rights issued by competent agencies under the old regime to land users.

– Other types of documents established before October 15, 1993 according to Government regulations.

Documents in someone else’s name

Clause 2, Article 100 of the 2013 Land Law stipulates that households and individuals using land that have one of the types of documents (as prescribed in Clause 1) with another person’s name on that document will be issued with a Book. red and do not have to pay land use fees with the following conditions:

– There must be documents on the transfer of land use rights signed by relevant parties such as: Documents, contracts for sale, donation, inheritance, conversion of land use rights

Households and individuals are using land without documents on land use rights

According to Clause 1, Article 101 of the 2013 Land Law, households and individuals using land before July 1, 2014 without documents on land use rights will be issued red books and do not have to pay land use fees. , If:

– Have permanent residence in the locality.

– Directly produce agriculture, forestry, aquaculture, and salt making in areas with difficult socio-economic conditions, areas with extremely difficult socio-economic conditions.

– Confirmed by the People’s Committee of the commune (ward or town) where the land is located that the person has used the land stably and without any disputes.

Land allocated without proper authority

Even though the land is allocated without proper authority, but if the land is used with stable housing, when the Certificate is issued, land use fees will not be collected in 02 cases:

– Using land with a house before October 15, 1993 and having documents proving payment to an agency or organization to use the land.

– Use land with stable housing in the period from October 15, 1993 to before July 1, 2004 and have documents proving that money has been paid to use the land, documents submitted in accordance with the prescribed tax rates of the Law. Land Law 1993.
