Mr. Huynh Chiem Phai – who was wrongly wronged for 43 years in the country, has now passed away and was compensated more than 1.67 billion VND by the People’s Procuracy of Khanh Hoa province.
On March 7, the representative of the People’s Procuracy of Khanh Hoa province said that they had paid compensation by bank transfer to Mr. Huynh Chiem Hoanh – Mr. Phai’s son, an amount of more than 1.67 billion VND.
This is the implementation of the 2022 appeal judgment of the Da Nang High People’s Court.
Accordingly, Mr. Tran Chiem Phai (died in 2015) and Mr. Tran Be (67 years old) were arrested by the Police of Phu Khanh province (currently Khanh Hoa province) in the murder case that occurred in October 1981.
The victim of the above case was the chairman of the People’s Committee of Ninh Giang commune (now Ninh Giang ward, Ninh Hoa town), who was shot dead on the way home from a meeting.
In February 1983, Mr. Phai became seriously ill so he was released on bail. After many years of not being able to prove the crime, in September 1984, the Provincial People’s Procuracy stopped investigating the case with these two defendants.
In September 2019, the People’s Procuracy of Khanh Hoa province apologized to the relatives of Mr. Phai and Mr. Be. A year later, Mr. Be was compensated 510 million VND.
Mr. Phai’s family requested compensation for damages of about 4 billion VND but was unsuccessful.
After that, Mr. Phai’s family and the People’s Procuracy of Khanh Hoa province negotiated many times to claim compensation for State liability but failed.
In 2022, the People’s Court of Khanh Hoa province issued a first-instance verdict accepting part of Mr. Phai’s family’s request, forcing the Khanh Hoa People’s Procuracy to pay more than 1.67 billion VND in compensation. After that, the two sides appealed to the High People’s Court in Da Nang.
Both sides then appealed together. The High Court of Appeal in Da Nang still ordered compensation for the above amount.
