Being unemployed is a complex situation that can generate uncertainty and economic difficulties. However, it is important to remember that workers who find themselves in this situation have the right to collect Unemployment Insurance, a fund that accumulates during their working life and that can be used to finance the search for a new job, start a business or cover basic expenses.

What to do if I don’t have a settlement?

The settlement is the document that formalizes the end of the employment relationship and is the most common to collect Unemployment Insurance. However, this document is not always accessible. Don’t worry, there are other alternatives:

  • Cards:

    • Dismissal: issued and signed by the employer.
    • Proof of dismissal letter: issued by the Labor Directorate.
    • Waiver: signed by you and ratified before a minister of faith.
    • Mutual agreement: signed by you and the employer, and ratified before a minister of faith.
    • Self-dismissal or indirect dismissal: signed by you.
  • Minutes:

    • Agreement: signed by the employer, you and a judge.
    • Appearance or judicial conciliation: signed by the employer, you and a judge.
  • Contracts:

    • Less than 30 days: signed by you and the employer.
    • Work and salary settlement for port workers: signed by you.
  • Other documents:

    • Certificate of termination of employment relationship from the Labor Inspection.
    • Electronic sworn declaration from the Labor Directorate (with electronic signature from you and the Labor Inspector).
    • Communication of termination of employment relationship due to bankruptcy of the employer (signed by the liquidator).
    • Conciliation before the Labor Directorate (signed by you and the employer, with a digital signature using the Unique State Code).
    • Judicial ruling (signed by a judge, with certificate of execution).
    • Labor lawsuit for unjustified, improper or unfair dismissal.
