He Public ministry (MP) presented this Thursday, March 14, a request for withdrawal of pretrial against the head of the Citizen Registry of the Supreme Electoral Tribunal (TSE), Ramiro Muñoz. The entity points this out to the possible commission of crimes of breach of duties and resolutions that violate the constitution.
The case in which the official is involved is related to the omission of the printing of the pink ballot for the election to the municipal corporation of San Miguel PetapaGuatemala.
Waldre Caldera, from the Prosecutor’s Office against Electoral Crimes, who raised the petition, pointed out that the crimes attributed to Muñoz are resolutions that violate the Political Constitution of the Republic and breach of duties.

Meanwhile, through a statement, the MP indicated that in the elections of June 25, 2023, the pink ballot of the political party Compromiso, Renovación y Orden (Creo) was omitted to be published to participate in the aforementioned election.
And although the plenary session of magistrates decided to repeat the elections, there were resignations of candidates so documents with forged signatures were presented and the voting was not carried out again.

Another lawsuit against the registrar
In August 2023, another petition was filed to strip Muñoz of his immunity. On that occasion, the prosecutor’s office pointed him out for possible abuse of authority for electoral purposes and breach of duties in a case related to Citizen Prosperity, which promoted Carlos Pineda as a presidential candidate.
Through a statement, the MP reported that the request to strip him of the right to pretrial was made because the Constitutional Court, in a resolution issued in May 2023, regarding the suspension of the political party, certified what was leading to the investigating entity. stating that the situation warranted an investigation.
In this context, preliminary investigation procedures were carried out through which it was possible to notice that Muñoz, abusing his position as Director of the Citizen Registry, possibly incurred illegal acts by abnormally registering the aforementioned political organization.
