Government allows legal regulations to withdraw 100% of the CTS

Withdrawal can be made until December 31 of this year

He Government has ratified the regulation of the law that allows employees freely dispose of 100% of your Compensation for Time of Service (CTS), with the purpose of meeting your needs due to the current economic crisis.

He Supreme Decree No. 003-2024-TRpublished in the official newspaper El Peruano today, contains the aforementioned regulations, which will also be available on the official websites of the Presidency of the Council of Ministers (www.gob.pe/pcm) and of Ministry of Labor and Employment Promotion (www.gob.pe/mtpe).

The regulation establishes that the Superintendency of Banking, Insurance and Pension Fund Administrators (SBS) is empowered to issue the relevant provisions within its scope of competence to ensure compliance with this supreme decree.

The regulation applies to private sector employees included in the scope of application of the Single Ordered Text of Legislative Decree No. 650Compensation Law for Time of Service, approved by the Supreme Decree No. 001-97-TRregardless of the labor regime to which they are subject.

Likewise, it applies to employees of state companies that are under the labor regime of the Single Ordered Text of Legislative Decree No. 728, Law of Labor Productivity and Competitiveness, approved by the Supreme Decree No. 003-97-TR.

Likewise, it includes civil servants of public sector entities that are under the labor regime of the Single Ordered Text of Legislative Decree No. 728Law of Labor Productivity and Competitiveness, approved by Supreme Decree No. 003-97-TR, as well as the civil service regime established in the Law No. 30057Civil Service Law.

Employees have the possibility of withdrawing on a single occasion and until December 31, 2024all of the Compensation for Time of Service (CTS) deposits accumulated to date in the financial institutions where they maintain their CTS account.

The regulation establishes that the employee has the option of request total or partial withdrawal of the available balance in your Compensation for Time of Service (CTS) deposit account.

To carry out this action, it is recommended that the worker request, preferably through digital platformsthat the financial institution makes the disbursement of the Compensation for Time of Service (CTS) through transfers to the accounts that the worker specifies.

Once the disbursement request is received, the financial institution make the transfer to the specified accounts by the worker within a maximum period of two business days.
