There are many complaints about food poisoning, people are victims of expired products.

Eyyub Huseynov, chairman of the Free Consumers’ Union, has repeatedly stated in his press release that expired products are collected after they are removed from markets and returned to imports. The importer also relabels and dates it as much as possible. We think it is a new product, but we are buying that old product as new.

There are many consumers who have been poisoned by the food they bought in stores. When I complained to those stores, they either said, “I’m sorry, there was a mistake,” or they denied, saying, “We can’t have old goods.”

Not to mention the sausages that are sold in front of subways, and neither the first nor the last date is known. These products poison people slowly, if not suddenly. It causes serious damage to all organs. Oncological diseases, which are spreading rapidly in our country today, are also the “fruit” of low-quality food.

Are there any punitive measures being taken against the markets that sell expired goods to people, endanger the lives of all of us, and poison them because of their own greed?

If the consumer is poisoned by the food he bought, can he demand compensation from that supermarket? Who should he contact to prove this?

Publika.az-In order to clarify all these questions, the employee studied the opinions of lawyer Khayal Bashirov.

According to his opinion, first of all, expertise should be determined for all this.

“According to the legislation of the Republic of Azerbaijan, the rights of consumers are protected by law. There is a law on consumer protection. At the same time, civil legislation regulates all points in this area. If any person as a consumer buys food or other food products from markets or other catering facilities, the requirements stipulated in the legislation regarding those food products must be observed. All products have a shelf life. It doesn’t matter if the expiration date has passed or not. If someone is poisoned by that product, he can file a claim against the restaurant where the product was obtained. There are different points here. For example, if an expired product is sold in the market and someone is poisoned by it, the examination determines that this person was poisoned by that product.

In this case, there will be an expert opinion. With that opinion, that person can file a lawsuit against the relevant catering facility, market. He can demand compensation for the damage caused to his health, and at the same time, he can take the steps provided for in the legislation regarding the responsibility of the relevant product persons of that object.

Before that, a citizen, individual as a consumer should apply to the Antimonopoly and Consumer Market Control State Service regarding the protection of consumers’ rights.

This service operates within the Ministry of Economy. Initially, the implementation of operative measures is very important for future court disputes. The reason is that at that moment, the issue of whether the relevant product is actually purchased from that establishment is clarified. At the same time, the issue of appointing and receiving an expert opinion should be resolved promptly so that the person does not face difficulties when applying for the relevant issue in the future.

If the product has expired, of course, the store, market or other catering facility that sells the product has responsibility in this matter.

If the product has not expired, if a person is poisoned by it, then the producer of this product is responsible.

Because of all this, there are claims in the legislation. If it did not cause any serious damage to a person’s health, in this case it creates administrative liability.

No, if he caused serious damage or if the victim changes his world, in this case, criminal liability arises, and according to the criminal legislation of the Republic of Azerbaijan, punishments such as payment of compensation and deprivation of liberty are also provided for.
