Abolish the procedure for issuing health certificates to drivers from 2024

On February 6, 2024, the Minister of Health issued Decision 295/QD-BYT announcing new and abolished administrative procedures within the scope of management functions of the Ministry of Health specified in Circular 32/ 2023/TT-BYT guiding the Law on Medical Examination and Treatment 2023.

Accordingly, the procedure for issuing health certificates to drivers is one of 12 procedures in the list of administrative procedures abolished under Decision 295/QD-BYT in 2024.

Specifically, the list of administrative procedures abolished from January 1, 2024 includes:

(1) Issuing health certificates to seafarers working on Vietnamese ships who meet the standards specified in Appendix I

(2) Issuing health certificates to seafarers working on Vietnamese ships who meet the health standards as prescribed in Appendix I but suffer from one or several diseases and illnesses specified in Appendix II

(3) Periodic health examination for seafarers working on Vietnamese ships

(4) Issuance of health certificate to the driver

(5) Periodic medical examination of car drivers

(6) Issuing health certificates to people 18 years of age or older

(7) Issuing health certificates to people under 18 years old

(8) Issuing health certificates to people who have lost civil act capacity or have no civil act capacity or have limited civil act capacity

(9) Periodic health check-ups

(10) Announcement of facilities qualified to perform driver health examinations under the authority of the Ministry of Health and other ministries and branches

(11) Announcement of facilities qualified to perform driver health examinations under the authority of the Department of Health

(12) Recognize quality management standards of medical examination and treatment facilities

Decision 295/QD-BYT takes effect from January 1, 2024.

And annul the following Decisions:

– Decision 889/QD-BYT dated March 17, 2015 of the Minister of Health on announcing new administrative procedures within the scope of management functions of the Ministry of Health;

– Decision 4759/QD-BYT dated November 9, 2015 of the Minister of Health on announcing amended and supplemented administrative procedures within the scope of management functions of the Ministry of Health;

– Decision 2510/QD-BYT dated April 17, 2016 of the Minister of Health on announcing new administrative procedures issued in the field of medical examination and treatment within the scope of management functions of the Ministry of Health;

– Decision 5921/QD-BYT dated September 28, 2018 of the Minister of Health on announcing amended, supplemented/abolished administrative procedures in the field of medical examination and treatment within the scope of management functions. of the Ministry of Health;

– Decision 2900/QD-BYT dated July 6, 2020 of the Minister of Health on announcing administrative procedures and abolishing a number of administrative procedures in the field of medical examination and treatment prescribed in Decree No. Decision 155/2018/ND-CP dated November 12, 2018 falls within the scope of management functions of the Ministry of Health.

Subjects of health examination according to Circular 32/2023/TT-BYT

Specifically, health examination subjects according to Circular 32/2023/TT-BYT include:

– Health check for Vietnamese citizens and foreigners living and working in Vietnam: periodic health check; health screening to go to school or work; Health examination for pupils and students;

– Health check upon request;

– Health check for Vietnamese people working abroad under contract.

Note, the health examination in Circular 32/2023/TT-BYT does not apply to the following cases:

– Outpatient and inpatient medical examination in medical examination and treatment facilities;

– Medical examination, forensic examination, forensic psychiatric examination;

– Examination to issue injury certificate;

– Occupational disease examination;

– Health examination for subjects under the management authority of the Ministry of National Defense and the Ministry of Public Security;

– Health check for specific industries and occupations.
