Why was former Vice Chairman of Bac Ninh Nguyen Luong Thanh not criminally prosecuted?

The Ministry of Public Security’s Investigation Police Agency did not consider criminal responsibility but proposed Party and administrative sanctions against Mr. Nguyen Luong Thanh, former Vice Chairman of the People’s Committee of Bac Ninh province.

The Ministry of Public Security’s Investigation Police Agency has prosecuted three defendants: Nguyen Nhan Chien (former Secretary of the Bac Ninh Provincial Party Committee), Nguyen Tu Quynh (former Chairman of the Provincial People’s Committee) for accepting bribes; Nguyen Van Nhuong (former Vice Chairman of the Provincial People’s Committee) for taking advantage of his position while performing official duties.

As a result of the investigation, the defendants Chien and Quynh admitted to agreeing on the policy of dividing 6 bid packages, directing and creating conditions for the group of companies of La Tuan Hung (Deputy General Director of AIC Company) and the AIC Company group of Ms. Nguyen Thi Thanh Nhan to win the bid.

Defendant Nhuong said that he received instructions from Mr. Chien and Mr. Quynh to agree to create conditions and sign decisions approving bidding plans so that the group of companies of defendants Dang Tien Phong (General Director of Song Hong Joint Stock Company), La Tuan Hung and AIC Company of Ms. Nguyen Thi Thanh Nhan could win the bid according to the list and price agreed upon by the investor and contractors in advance, causing damage to State assets.

The investigation conclusion of the Ministry of Public Security’s Investigation Agency mentioned the responsibility of the Provincial Party Committee and the People’s Committee of Bac Ninh Province. The Investigation Agency said that, for Mr. Nguyen Luong Thanh, when holding the position of Vice Chairman of the Provincial People’s Committee, he signed a decision on allocating capital for basic construction investment in the 2014-2016 period from additional government bond capital for projects in Bac Ninh Province, including 6 district-level general hospitals.

The investigation results so far have no evidence to prove the intervention and influence at all levels to request additional capital allocation for projects in Bac Ninh province and there are no documents showing the direction and intervention for Mr. Thanh to sign the decision to allocate capital for the 6 district-level general hospital projects mentioned above.

Therefore, the Investigation Police Agency does not consider criminal responsibility but proposes Party and administrative sanctions against Mr. Nguyen Luong Thanh.

In June, Deputy Prime Minister Tran Luu Quang signed the Prime Minister’s decisions to discipline four former Vice Chairmen of the People’s Committee of Bac Ninh province: Nguyen Tien Nhuong, Nguyen Van Phong, Nguyen Huu Thanh, and Nguyen Luong Thanh.

In Decision No. 513, the Prime Minister decided to discipline by removing the position of former Vice Chairman of the People’s Committee of Bac Ninh province for the 2011-2016 term for Mr. Nguyen Luong Thanh, due to violations and shortcomings in his work and the Secretariat has disciplined him in terms of the Party.

The Investigation Police Agency also recommended that the People’s Committee of Bac Ninh province and competent authorities consider handling the 13 companies with warnings, fines, and bans from participating in bidding activities.

These companies include: National Technology Joint Stock Company; Intop Joint Stock Company; Golden Lotus Company; Song Hong Technology and Communication Joint Stock Company; Nhat Nam Sanitary Equipment Company Limited; Van Xuan Science and Technology Equipment and Materials Joint Stock Company; Danh Medical Equipment Company Limited; Viet Long Joint Stock Company; AIC Company; Mopha Company; Global Prestige Joint Stock Company; Environmental Consulting and Solutions Joint Stock Company and High Technology Consulting Joint Stock Company.
