What was the arrest and release of ‘El Mencho’s’ brother like?

The arrest of Abraham Oseguera Cervantes, known as “Don Rodo”, brother of Nemesio Oseguera Cervantes, leader of the Jalisco New Generation Cartel (CJNG), took place inside a private home, without a search warrant, thus contradicting the report initial of the National Guard (GN). The Attorney General’s Office (FGR) confirmed this discrepancy in a statement, supporting the position of Oseguera Cervantes’ legal defense, which argued that the elements of the National Guard had provided false information in their approved police report on the details of the detention.

The defense of Oseguera Cervantes explained that the release of “Don Rodo” was achieved because it could be verified, through the presentation of various evidence, such as different videos that Oseguera Cervantes was not arrested in flagrante delicto as the National Guard initially claimed.

In the recordings of a few minutes, the arrival of elements of the National Guard to the Hacienda Real subdivision, located in Autlán, Jalisco, is observed, who later entered the home of the brother of the leader of the Jalisco New Generation Cartel, Nemesio Oseguera Cervantes, to arrest him. .

Initially it was said that, on April 21, the National Guard units observed three people outside the aforementioned home, carrying firearms and in a belligerent attitude, who threatened them and entered said home, closing the door.

The FGR also indicated that Oseguera was carrying a 5.56 x 45 caliber assault rifle long weapon and a .9 millimeter caliber short weapon, as well as a purse-bag with 38 grams of cocaine; two thousand 011 fentanyl pills and 255 pills of another narcotic.

Two days after his arrest, a federal judge ordered preventive detention for Oseguera Cervantes for his alleged involvement in crimes related to the carrying of firearms for the exclusive use of the Army and the possession of narcotics for commercial purposes, in accordance with established by law. The case was sent to the Federal Criminal Justice Center in the State of Mexico, based in Almoloya de Juárez, where in the detention control hearing, the judge qualified the detention of “Don Rodo” as legal.

After hearing the accusation, Oseguera Cervantes’ defense requested additional time to gather more evidence in favor of their client. In response, the federal judge granted an additional 144 hours to carry out the necessary procedures, setting the deadline to conclude the initial hearing on Saturday, April 27 at 10:00 a.m.

In the continuation of the hearing, Oseguera’s defense, lawyer Víctor Beltrán García, presented nine witnesses who noted various omissions committed by the authorities.

The first to testify were two computer experts who presented various recordings provided by neighbors, according to Animal Político, in which it was identified that two subjects were detained by elements of the National Guard, but only “Don Rodo” boarded the helicopter to destination to the capital of the country.

Audio and videos were presented that were supposedly extracted by professional technical experts, evidencing the moment in which approximately between 15 and 25 members of the National Guard arrived, who began to knock and break the doors to enter the home.

Judge Rogelio León Díaz ordered the release of Oseguera Cervantes after considering that the detention of “Don Rodo” was contradictory to what the National Guard stated in its Police Report.

As mentioned previously, two municipal police officers also participated in the hearing and claimed to have suffered attacks by members of the National Guard, facts that they reported to the MP.

Previously, the FGR had described the complaint as “complicit and cover-up conduct and evidence of the collusion and complicity of local police authorities.”

In addition, neighbors and relatives of “Don Rodo” showed up to testify about his innocence and denounce alleged abuses, beatings and robberies by federal elements during the operation.

The authorities’ version is implausible

Judge León Díaz determined that the carrying of weapons and drugs is “implausible” due to Oseguera’s age and health, and that no fingerprints were found.
