While the ruling is specific to the state of Colorado, the nation’s highest court said it applies to other states as well.
The Supreme Court ruled on Monday local time. According to the judgment, according to the constitution, no state can disqualify anyone from being a candidate for the post of central government. Only Congress can enforce this section of the Constitution.
Trump considers the verdict a big victory for America. After the verdict was announced, Trump said in a post on his established social media platform Truth Social, “This is a great victory for America.”
However, Colorado Secretary of State Gina Griswold expressed displeasure after the verdict. He also commented that through this judgment, the authority of the state has been taken away in the implementation of the third article of the fourteenth amendment of the constitution.
On December 19, 2021, Trump was disqualified from the Colorado Republican primary by the state Supreme Court for his involvement in the riots at the US Capitol on January 6, 2021. The Colorado Supreme Court claims that according to the Fourteenth Amendment of the US Constitution, the court has the authority to disqualify a person from public office if he incites or supports anti-state activities. Illinois and Maine made similar efforts citing this article.
But in Monday’s ruling, Supreme Court justices said only Congress has the power to disqualify someone from election under that constitutional amendment. States do not have this jurisdiction. The Colorado Supreme Court’s decision is wrong.
The ruling clears the way for Trump to participate in the Colorado primary. Colorado’s primary voting is scheduled for Tuesday.
