The government of Mexico published in the Official Gazette of the Federation (DOF) the decree to reform the Federal Penal Code and the General Health Law, to prohibit Efforts to Correct Sexual Orientation and Gender Identity (ECOSIG), also known as conversion therapies, throughout the country.
In this way, the decree comes into force today, June 8.
The decree states that: “two to six years in prison and a fine of one thousand to two thousand times the daily value of the Measurement and Update Unit will be imposed on anyone who performs, imparts, applies, forces or finances any type of treatment, therapy.” , service or practice that hinders, restricts, prevents, undermines, nullifies or suppresses the sexual orientation, gender identity or expression of a person.
In addition, the penalty will increase double in the event that the classified conduct is carried out against minors under eighteen years of age, older adults or people with a disability.
It adds that “in the event that it is the father, mother or guardian of the victim who engages in the sanctioned conduct, the sanctions of reprimand or warning will be applied to them as considered by the judge.”
Furthermore, the sanctions indicated in the first paragraph will increase to double the corresponding amount when the perpetrator has any of the relationships stated below with the victim, or who may be in any of the cases.

Although they were banned for representing practices that have encouraged the violation of the human rights of the LGBTTTIQ+ community, they are still common in the region.
It adds that in those cases of subsections a) and b), in addition to receiving the sanctions that are already indicated, the punishment will be dismissal and disqualification from holding the position or commission or any other of a public or similar nature, up to a period equal to the penalty imposed.
They emphasize that the presentation of a complaint will be sufficient to begin the investigation of the facts that bear the characteristics of the crime to which this provision refers.
