Congress analyzes conditions to access funds

The parliamentarians who belonged to the parliamentary group Free Peruat the initiative of the congressman Guido Bellido Ugartepresented the Constitutional Reform Law that modifies article 12 of the Political Constitution of Peruwhose chapter II refers: “Of social and economic rights”.

The bill aims to carry out a constitutional reform in said article of the Carta Magnain order to guarantee the subsistence of the contributors, both National Pension System and Private Pension Fund Administrators (AFP)in the event that they go through economic contingencies, and authorize the return of up to half of their contributed amounts, whether in both pension systems, as long as they put their health or subsistence at risk.

On this pension issue, the Constitution current from 1993 says in its 12th section:

Article 12. – Social security funds and reserves are intangible. The resources are applied in the manner and under the responsibility that the law states.

Meanwhile, the modification proposal proposed by the congressman Bellido Ugarteis given in the following terms:

Article 12. – Social security funds and reserves are intangible, except for those that correspond to contributions made to the National Pension System and to the Private Pension Fund Administrators, in which case up to half of the total amount contributed can be returned, with the purpose that contributors face exceptional situations that put their health or subsistence at risk. The resources are applied in the manner and under the responsibility established by law.

With this constitutional reform bill of Article 12 of the Constitutionit is intended that all contributors to the SNP-ONP y SPP-AFPaccess their contributions in case emergency contingencies arise, such as health and subsistence situations.

Likewise, they propose modifying the condition of intangibility of pension funds, as currently in article 12 of the Carta Magna is established; and they plan to modify it, so that citizens enjoy the purpose of what the right to social security implies.
