They lift a millionaire embargo that weighed on the assets of IPS

ASSUMPTION. The Legal Directorate of the Social Security Institute confirmed the lifting of an embargo worth 1,568,718,408 million guaraníes. The case is within the framework of the trial titled “Basilio Agüero and others against IPS on execution of sentence year 2012 No. 459.”

The trial corresponds to an execution of a sentence through which the court had ordered the seizure of the pension sums of money by order dated February 29, 2012.

Subsequently, the same Court ordered by AI 310 dated September 14, 2012 to lift the executive embargo decreed in the proceedings, considering that the assets of the IPS are not subject to seizure under art. 530 of the CPC and art. 717 of the same Legal body.

The Labor Appeal Court by AI N 120 dated May 28, 2013 confirmed the ruling by the Court of First Instance.

By law, IPS assets cannot be seized. Furthermore, they explained that they can only request inclusion in the IPS Budget in the event of final judgments being enforced.
