MEXICO CITY (process.com.mx).– “Everything wrong on the part of Mayor Benito Juárez,” declared the Head of Government, Martí Batres, when announcing that the Comptroller General of Mexico City found 12 irregularities in the work from the Portales neighborhood, “Residencial Novus”, allegedly responsible for having drilled the tunnel of Line 12 of the Metro Collective Transportation System (STC).
This Friday, in a conference, the president referred to the events of March 14, when the fall of water and mud was recorded at the Eje Central-Parque de los Venados interstation on Line 12: “We said when this happened, it was already weeks ago, that investigations would be carried out by two instances, one that immediately appears because it has to do the expert opinion, is the Attorney General’s Office of Mexico City (…) the Comptroller General’s Office also carried out an investigation.
Then, he gave the floor to the secretary of the Comptroller General of Mexico City, Juan José Serrano Mendoza, who explained that the irregularities indicate the possible commission of serious administrative offenses, consisting of abuse of functions.
And he detailed the 12 irregularities detected:
- The leak was caused by a real estate project located at Avenida División del Norte, number 2238 bis, Colonia Portales, Alcaldía Benito Juárez, called “Residencial Novus.”
- The Mayor’s Office issued, on March 5, 2021, the Alignment Certificate and Official Number for the property where the aforementioned work was carried out, without it being duly registered in the Alignment and Rights of Way Plans, as recorded in the public records of the Secretariat of Urban Development and Housing.
- The Mayor’s Office registered the Construction Manifestation FBJ-0022-23 with a validity of three years from May 31, 2023, without compliance with the provisions of the Construction Regulations for the Federal District.
- The construction that damaged the Metro facilities took place for more than 10 months, without the district noticing the inconsistencies in the file.
- The work does not have a Special Construction License for Excavations on this property.
- The Special Construction License for Total Demolition had expired, and did not authorize excavations greater than one meter deep, this is relevant.
- There is no record of the review by the co-responsible for structural safety.
- They did not present the project for the construction of the passenger elevator, which is essential in the works from the fifth level.
- The project exceeds the construction meters allowed in the Single Zoning and Land Use Certificate.
- There is no record or precedent of the “approval” for construction that was to be issued by the General Subdirectorate of Maintenance of the Metro Collective Transportation System.
- Construction work on these sites had been suspended due to non-compliance with safety measures.
- The Benito Juárez Mayor’s Office and the Administrative Verification Institute (Invea) carried out two visual inspections in which the suspension seals placed were not observed, so there was evidently a violation of the suspension state on the day of the damage to the Metro facilities. .
The official clarified: “The public servants involved were attached to the General Directorate of Urban Development, the Subdirectorate of Regulations and Licenses and the Head of the Departmental Unit of Demonstrations and Special Construction Licenses.”
