A judge has again filed the case for the liver transplant in April 2012 to former Barcelona Football Club player Eric Abidal, concluding that no type of payment has been credited to the donor, a cousin of the former French international.

In his statement before the judge in November 2018, Abidal, who at that time served as technical secretary of FC Barcelona, ​​denied that he financially compensated the liver donor and defended that they acted in a “totally legal” manner.

Once the Prosecutor’s Office and the other parties have explained to the judge that it was not necessary to extend the investigation because the essential procedures to clarify the facts had already been carried out, the magistrate has closed the case, as she already did in 2018 after The National Transplant Organization concluded that the liver transplant from a living donor to Abidal “was carried out in accordance with the law.”

To close the case again, the judge now emphasizes that, as a result of a rogatory commission on the donor’s assets, no “obvious” increase has been detected, despite the fact that if any payment had been made for the transplant it would have been detected.

According to his insistence, the procedures carried out “do not in any way show the payment, as a fundamental requirement of the criminal offense charged”, nor has it been proven “reliably or in an indicative manner”, since “if the payment had existed, there would be an increase in assets. ” in the donor, which “has not been verified.”

The donor claimed to be Abidal’s first cousin

The judge highlights that the donor claimed to be Abidal’s first cousin and that it was the former soccer player’s wife and mother who contacted him to ask for the transplant – the athlete suffered liver cancer – to which he agreed and, after performing the operation at the Hospital Clínic, he stayed for a few days at his cousin’s house before returning to France, without ever receiving any financial compensation.

Furthermore, remember that Juan José Castillo also testified that in his conversation with Rosell he used exaggerated expressions that were not “literal truth”, since he was angry with Abidal for some statements he had made regarding the FC Barcelona Board of Directors.

Abidal also maintained before the judge that neither Rosell nor Castillo participated in the transplant process and that the entire procedure was carried out between the Barça club doctor and the Hospital Clínic staff.

For his part, Rosell testified that when in his conversation with Castillo they stated that they saved Abidal’s life, they were referring to his professional and economic life, because, despite his illness, Barça renewed his contract without knowing if he would be able to return. play, while insisting that no payment was made to facilitate the transplant.

The filing order also highlights that the judge who processed the file on the transplant ratified its legality and specifies that when she requested photocopies of the documentation, they were made incorrectly, so at first she thought there could be some irregularity, although its legality was later verified.

The judge recognizes in her report that it has not been possible to prove the kinship relationship between Abidal and the donor through DNA, since there is “genetic distance” between them, since he is the biological son of a sister of the “alleged biological father.” ” from the former soccer player.
