They encouraged to bribe a SRS official, but the bribe was appropriated for himself. KNAB urges the company employee to be charged

The evidence obtained in the KNAB pre-trial investigation shows that an employee of a military and other equipment supply and wholesale company may have convinced the company’s commercial director to try to bribe an SRS official. The purpose of the possible bribery was to get the decision on the results of the tax audit of the given company to be amended and criminal proceedings not to be initiated, KNAB informed.

The investigation revealed that the employee of the company had promised to hand over the 10,000 euros received as a bribe to an intermediary who was allegedly known to some SRS officials, but as a result he appropriated the money for himself. On the other hand, the commercial director of the company, who gave the bribe to the employee of the company, reported this fact to KNAB and provided the necessary information for the investigation.

KNAB’s investigation did not establish the involvement of SRS officials in this criminal offense.

KNAB started the criminal process on August 17, 2023, and as a result of the pre-trial investigation, initiated criminal prosecution against the employee of the company for embezzlement of a bribe.

The legislator has determined that a person can be exempted from criminal liability if, after giving a bribe, he voluntarily notified the investigative body about the incident and actively contributed to the detection and investigation of the criminal offense. Thus, in relation to the commercial director of the company, the KNAB made a decision to terminate part of the criminal proceedings, because the person voluntarily reported the illegality and cooperated with the KNAB.
