After a year of intense internal crisis, the PDT begins 2024 without a party body in Ceará. The mandate of the state directorate expired last Sunday, December 31, 2023. Since the party body has not yet been renewed within the validity period, a provisional commission must be established before the directorate election can be called.
This process must be led by the interim national president of the PDT, the federal deputy André Figueiredo (PDT). He was one of the protagonists of the tug-of-war that involved the command of the PDT Ceará in 2023. Until then president of the state of the party in Ceará, he rivaled the senator Cid Gomes (PDT) to chair the directorate throughout the year.
The controversy even led to the deactivation of the state directorate and its replacement with a provisional commission, which was revoked through legal action. The national executive of the PDT also attempted to intervene in the state directorate, which was also prevented by the courts.
Now André Figueiredo is articulating the establishment of a party body in Ceará, but there is no decision yet, the deputy’s press office informed. Also according to the note, Figueiredo spoke with some leaders, including the Minister of Social Security, Carlos Lupi, licensed national president of the PDT.
According to the president of the Electoral Law Commission of the Bar Association – Ceará Section (OAB-CE), Fernandes Neto, there is no specification in the legislation regarding the time in which the party can remain without a directorate or provisional commission.
“There can be no party act,” he explains, speaking of the period in which there was no party body in Ceará. The party acts envisaged include, for example, party affiliation and the holding of conventions, necessary for the choice of candidates and the formation of coalitions in the State.
Fernandes also recalled a recent Federal Supreme Court (STF) decision that established “reasonable” deadlines for interim commissions once they are in place.
“A recent decision of the STF established that the parties should set in their statutes reasonable terms for the provisional committees, which would have the aim of forming the state directorate which will have a mandate foreseen by the statute. The reasonable term, according to the jurisprudence of the TSE (Higher Electoral Court) would last 6 months. The list could last one, two or even four years, depending on the statute,” he explained.
Deadlock in PDT Ceará
The crisis in PDT Ceará worsened in 2023, after a turbulent election campaign for state government in 2022, when the party split. Last year, the impasse centered on the command of the state directorate, until then commanded by André Figueiredo.
Senator Cid Gomes, then vice president of the collegiate, announced, in the first half of the year, his interest in chairing the party because he believed it represented the “majority sentiment” of those who were part of it. The main interest of the wing led by the former governor was to restore the alliance with the PT and officially join the governor’s allied base Elmano de Freitas (PT).
Initially there was an agreement and Figueiredo took leave so that the CID could take over the presidency. However, it only lasted two months. Subsequently, André Figueiredo regained command of the state directorate, which forced the CID’s allies to summon the members of the collegiate and call a new vote for the presidency.
The standoff eventually ended up in court, being the subject of several judicial decisions over the weeks. Ultimately, Cid Gomes managed to hold on to the presidency until the end of December, but at that time he was already articulating the exit of the group he led from the PDT – which is expected to be completed now, in 2024.
