Zora’s (2) parents have been unfairly fined several times for their daughter’s wheelchair bus. When they object repeatedly, they feel their only option to enforce their rights is through the courts. According to the ombudsman, the municipality often makes mistakes when it comes to errors in parking permits and the handling of such objections: “People often feel helpless.”

Mujtaba lives with his young family in Noord. His daughter Zora has a rare muscle disease and that is why, after a long administrative process, they received a disabled parking permit a few weeks ago. This would allow them to park for free anywhere in the city. But after a week there were two parking fines on the mat, while the card was still in the car.

The Municipality’s scanner cars cannot register the disabled card, but only scan the license plates. And even today that plate is not regularly registered with the Municipality.

After several attempts to contact the municipality and objections, according to the municipality there was no choice but to go to court. After AT5’s inquiries to the municipality, the fines were revoked and an apology was issued. “It’s fine, of course, but it shouldn’t be that way. Not even because I got that apology a week ago and just got fined again,” says Mujtaba.

Recognizable

Ombudsman Munish Ramlal calls it a recognizable example. The errors and mistakes made by the scan cars often lead to unjustified fines, but above all the municipality could do much better, in his opinion. “People often feel helpless when they try to agree something with the municipality and can’t get it done. Not even with an objection procedure, then they are sent from pillar to post. Types of files, rules or systems often seem more important aspects of human contact.”

Mujtaba: “Sometimes you feel helpless or sad. We often had to cry about this. Then we thought: is it really necessary to cry about the formalities instead of why we ended up in this situation? We would much rather spend our time about our family, and that is sometimes painful,” he says.
