The Government Council approves projects and appointments

A government council, headed by Aziz Akhannouch, was held today, Thursday, and was devoted to deliberating and approving a number of draft legal texts, reviewing an international agreement, and deliberating on proposals for appointment to senior positions in accordance with Chapter 92 of the Constitution.

The Presidency of the Government indicated, in a statement, that “at the beginning of the work of this Council, and in connection with Draft Law No. 22.24 amending and completing Law No. 47.18 relating to the reform of regional investment centers and the establishment of unified regional committees for investment, its broad outlines were presented and discussed with a view to submitting it for approval in the Council.” Later government.”

After that, the Government Council deliberated and approved draft Decree No. 2.23.1119 specifying the methods for maintaining the list of arbitrators and the conditions for registering and finalizing it, presented by Abdel Latif Wehbe, Minister of Justice.

The communication explained that this project comes in implementation of the requirements of Article 12 of Law No. 95.17 relating to arbitration and mediation, the agreement issued by Royal Decree No. 1.22.34 dated Shawwal 23, 1443 (May 24, 2022), which stipulates that private persons who carry out arbitration tasks on a regular basis or Within the framework of the profession to which they belong, individually or as a legal person, they must be registered on a list of arbitrators. This article also referred to a regulatory text that specifies the methods for maintaining this list and the conditions for registration in it and termination from it.

In this context, and under this draft decree, the governmental authority in charge of justice is entrusted with keeping the list of arbitrators, specifying the data to be included in it, the registration procedure, as well as the cases in which registered arbitrators are to be terminated.

Subsequently, the Government Council deliberated and approved draft Decree No. 2.23.681 relating to the design, production, maintenance and seaworthiness of aircraft, presented by Mohamed Abdel Jalil, Minister of Transport and Logistics.

The communication indicated that this project comes in implementation of some provisions of the first section of Law No. 40.13 related to civil aviation, as many of its provisions were referred to regulatory texts in order to determine the technical standards and conditions for accreditation of persons working in the fields of aircraft design, production, maintenance, and management of maintaining their suitability for navigation. It also falls within the framework of the compatibility of national legislation with the provisions of the Agreement on International Civil Aviation signed in Chicago on December 7, 1944, issued by Royal Decree No. 1.57.172, whose Annex No. 8 specifies the technical standards and conditions that must be respected in order to ensure the seaworthiness of aircraft regardless of the situation. At the stage of its design, production or maintenance.

The draft of this decree aims to “specify the technical specifications that must be respected by persons wishing to obtain the accreditation received by the governmental authority in charge of civil aviation in order to carry out the process of designing, producing and maintaining aircraft in Morocco.” Determine the conditions for the accreditation of natural and legal persons in order to carry out the process of maintaining the seaworthiness of aircraft as one of the activities that contribute to ensuring the safety of air navigation; In addition to determining how the governmental authority in charge of civil aviation carries out monitoring operations.”

The Government Council continued its work by reviewing an agreement concluded within the framework of the United Nations Convention on the Law of the Sea regarding the conservation and sustainable use of marine biological diversity in areas beyond the limits of national jurisdiction, approved in New York on June 19, 2023 and signed by the Kingdom of Morocco on September 21, 2023. “And Draft Law No. 10.24 hereby approves the aforementioned agreement,” presented by Leila Benali, Minister of Energy Transition and Sustainable Development, on behalf of Nasser Bourita, Minister of Foreign Affairs, African Cooperation and Moroccans Residing Abroad.

The communication noted that “this agreement aims to conserve marine biological diversity in areas beyond the limits of national jurisdiction and use it sustainably through the effective implementation of the relevant provisions of the Convention as well as the promotion and consolidation of international cooperation and coordination.”

The Government Council concluded its work by deliberating and approving proposals for appointment to senior positions in accordance with Article 92 of the Constitution, where at the level of the Ministry delegated to the Prime Minister in charge of relations with Parliament, Shafiq Al-Wedghiri was appointed as Secretary-General. At the level of the Ministry delegated to the Prime Minister in charge of digital transition and administrative reform, Mohamed Ibrahimi was appointed Inspector General.

At the level of the Ministry of Higher Education, Scientific Research and Innovation, the communication stated that Belaid Boagalen was appointed director of the National School of Applied Sciences in Beni Mellal, and Ali Haitouf was appointed director of the Higher Normal School in Fez. At the level of the Ministry of Industry and Trade, Al-Hassan Masoudi was appointed Director of Human and Financial Resources, Information Systems and Public Affairs.
