After the elimination of the Federal Conciliation and Arbitration Board in Torreón, the process for resolving files remains “pending”, so labor lawyers seek to form a “common front” with associations, bars and human rights organizations to guarantee that the rights of the worker are respected.
Representatives of around 20 offices met to analyze the possible actions they could carry out after the closure of Federal Board 42 in Torreón, as well as the way to give certainty to the cases that were ongoing before this instance and that now they will be attended to in Monterrey and Saltillo.
“Fundamental rights are being violated, specifically constitutional 17: we must have access to prompt, expeditious and free justice,” said Enrique Rodríguez Caro, president of the Association of Labor Lawyers.
He pointed out that the matters against the Mexican Social Security Institute (IMSS) are going to be transferred to the Nuevo León boards, which are numbers 19 and 20 and the rest of the matters that are in process or in the procedural state, to Board 25 with residence in Saltilloso the worker would now have to follow the procedure outside the region, which implies expenses.
He recalled that these changes are due to the May 2019 reform, but there it is established that a plan and work program must be established to conclude the matters in process, but there are about 8,000 to 9,000 matters in the backlog that will be had. to send to another Board. In this sense, he considered that the Ministry of Labor and Social Prevention must report on the plan and work program for the conclusion of the matters in process.

The lawyers indicated that there should also have been a processing office, but that was not the case, so the closest one is in Durango, also outside the lagoon region.
“We are going to do an analysis and I think that, since the Decree that derives from this is already in place, I think that what we have to do is give us an answer and that our issues stop having that delay, even if it is in Saltillo, but that matters really come out in the terms established by the law, we do not demand more than what the law says,” he explained.
