The ex-director of Kazselezaschita, accused of bribery, was acquitted in court

The jury in the specialized interdistrict criminal court of the Almaty region considered a criminal case against officials of the territorial division of the Ministry of Emergency Situations of the Republic of Kazakhstan, Liter.kz reports with reference to the specialized interdistrict criminal court of the Almaty region.

The former head of the state institution “Kazselezaschita” K. and his deputy A. were accused of receiving personally in a group of persons by prior conspiracy a bribe on an especially large scale for actions and inactions within their official powers, as well as for general patronage (clause 3 part 3 of article 366 of the Criminal Code). In addition, K. was charged with committing the same acts more than once (Part 4 of Article 366 of the Criminal Code).

Director of TOO P. was accused of causing property damage by deception and abuse of trust, in the absence of signs of theft, using his official position, causing large damage (clause 2 part 4 of article 195 of the Criminal Code) and giving a bribe to an official personally in the form of money on an especially large scale (Part 4 of Article 367 of the Criminal Code).

The court found that On December 22, 2022, defendant A., being the deputy head of the State Administration, using his official capabilities, received a bribe from the director of the contracting organization Zh., with whom an agreement was concluded for the construction of mudflow protection dams.

For the smooth signing of work completion certificates and general patronage, the bribe giver transferred more than $397,621. And the defendant P., being the director of the LLP, gave a bribe to the deputy head of the State Administration in the amount of 397,621 US dollars for the unhindered signing of acts of work performed and general patronage.

By verdict (majority vote) of the jury:

• K. is acquitted of the charges brought against him.
• A. was found guilty under Art. 366 part 4 of the Criminal Code, according to which he was sentenced to 11 years in prison, with lifelong deprivation of the right to hold positions in the civil service.
• According to the episode of December 5, 2022, under Article 366 Part 4 of the Criminal Code, defendant A. was acquitted.
• P. was found guilty under Art. 367 part 4 of the Criminal Code, he was sentenced to 11 years in prison, with lifelong deprivation of the right to hold positions in the civil service.
• According to the episode of December 5, 2022 under Art. 367 part 4 of the Criminal Code and under Art. 195 part 4 clause 2 of the Criminal Code, defendant P. is acquitted.

The verdict can be appealed and protested to the Almaty Regional Court through the district court within 15 days from the date of proclamation.
