In the advertising branch of the case, according to earlier information, the police investigated the suspicion that the sum of 272 million crowns from Agrofert companies between 2010 and 2013 did not actually go to advertising, but helped Čapí hnízd repay the loan and the Agrofert holding to reduce taxes. The advertising payments were suspected to be either fictitious or overpriced.

The police have already dismissed the case once. In June 2022, it stated that the evidence showed that the advertising spots, audiovisual production or promotional material had actually been created. Her decision was subsequently confirmed by the Prague municipal prosecutor’s office, but the Supreme State Prosecutor’s Office (VSZ) in Prague canceled the decision. The police had to investigate the matter further. At the end of February this year, they came to the conclusion that there was no suspicion of a crime, and their decision was confirmed a month later by the supervising prosecutor. VSZ did not intervene this time.

Agrofert belongs to the trust funds of the chairman of the ANO movement and former prime minister Andrej Babišwho is facing indictment in connection with the subsidy for the construction of the Čapí hnízdo complex together with his former adviser Jana Nagyová. State representative Jaroslav Šaroch in this branch of the case, they claim that Babiš, together with Nagyová, ensured the withdrawal of Farma Čapí hnízdo from Agrofert in such a way that it seemingly met the conditions for obtaining a subsidy of fifty million for small and medium-sized enterprises. Both Babiš and Nagyová have denied guilt for a long time. The court acquitted both defendants for the second time in February, the decision is not yet final.
