TC declares the mutualization of its debt unconstitutional

The Plenary Session of the Constitutional Court (TC) decided, by a slim majority, with 6 votes in favor and 4 against, to accept the unconstitutionality request presented by a group of pro-government senators regarding the short isapres law.

This requirement, presented on February 2 by senators Juan Luis Castro (PS), Daniel Núñez (PC), Claudia Pascual (PC) and Juan Ignacio Latorre (RD), pointed to the unconstitutionality of the indication raised by the opposition. In it, the mutualization of the debt of the insurers of the more than 700 thousand contributors who suffered excessive collections was sought.

The opposition measure sought to reduce the debt ordered by the Supreme Court from $1.18 billion to just $451 million. The opposition described this as a “pardon” to private health insurers. For this reason, after collecting 17 signatures from pro-government and Christian Democracy (DC) senators, the request was admitted for processing by the TC.

Within the framework of the process, the Government finally made observations and became a party, also requesting the allegations.

Senator Núñez expressed his satisfaction with the decision of the TC, pointing out that “the article that allowed the shamelessness of lowering the refund to contributors is invalidated.”

“With great satisfaction, we can tell the citizens that justice, truth and reason have prevailed, because the Constitutional Court has welcomed and supported our challenge so that never again will anyone, other than the Government, the Executive Branch, anyone That this is the case, he has the health insurance contributions,” Senator Castro added.

Senator Yasna Provoste (DC) also celebrated the decision of the Constitutional Court, stating that “today justice prevails” and that the isapres must comply with the ruling of the Supreme Court.

“No one wants the Isapres to collapse or collapse, no one, what we want is justice, for them to pay what is fair, because they charged the people, no more and no less. The mechanisms and the rest will be looked for, but today the TC, in a majority ruling, has recognized that mutualization is unconstitutional,” commented Senator Iván Flores (DC).
