Suspense for the Moro trial in Paraná

The end of the mandate of Judge Thiago Paiva, of the Regional Electoral Tribunal of Paraná (TRE-PR), could make the judgment on two actions that ask for the revocation of the mandate of Senator Sergio Moro (União-PR) unfeasible, recorded The globe.

The judge will remain in office until Tuesday 23rd, one day after the resumption of sessions in the presence of Paraná TRE.

To analyze Moro’s possible impeachment, the Court must have a maximum quorum of seven judges, as established by the Electoral Code.

“Decisions of regional courts on any action resulting in revocation of membership, general annulment of elections or loss of diplomas (mandates) can only be taken in the presence of all its members.”

Since December 2019, Thiago Paiva has occupied one of the TRE-PR vacancies reserved for judges belonging to the legal professions.

According to the newspaper, Paiva could be replaced by two fellow judges who are part of the “reserve bank” of TRE Paraná — José Rodrigo Sade and Roberto Aurichio Junior —, but their mandate also expires next week, on January 27.

Appointment of Lula’s hands

Condemned by Moro as part of Operation Lava Jato, President Lula (PT) must appoint Thiago Paiva’s replacement in the TRE of Paraná.

However, to make the nomination, the PT member must receive the triple list sent by TRE-PR to the TSE, which must approve the nominations.

José Rodrigo Sade, who appears on the triple TRE-PR list, being more likely to vote for Moro’s impeachment, is the PT’s favorite to take office.

The deputy calls for Moro’s impeachment

The Paraná Public Electoral Ministry (MPE-PR) expressed its support for the partial acceptance of the electoral action carried out by the PL and the PT which calls for the revocation of the mandate of Senator Sérgio Moro (União-PR).

The parties’ accusation is that Moro committed an abuse of economic power during the pre-campaign for the 2022 general elections.

The opinion, signed by prosecutors Marcelo Godoy and Eloisa Helena Machado, was filed on December 14, 2023 and transmitted to the Regional Electoral Tribunal of Paraná (TRE-PR).

The electoral action was proposed at the end of 2022 on two occasions, one by the PL party and the other by the Brasil da Esperança federation, made up of PT, PV and PCdoB. Both were united in the same action. They accuse Moro of abuse of economic power and improper use of vehicles or means of social communication during the 2022 pre-election period.
