Jakarta, CNBC Indonesia – South Africa has filed a lawsuit against Israel at the International Court of Justice (ICJ). This lawsuit contains allegations that Israel committed crimes of genocide against Palestinians in Gaza after nearly three months of continuous bombing by Israel.
As is known, this Israeli attack killed more than 21,500 people and caused widespread destruction in the besieged enclave.
In its application to the court on Friday (19/12/2023), South Africa described Israel’s actions in Gaza as genocide because they aimed to destroy most Palestinian national, racial and ethnic groups.
“The acts at issue include killing Palestinians in Gaza, causing severe physical and mental suffering, and subjecting them to living conditions expected to cause them physical destruction,” the lawsuit reads.
The ICJ, also called the World Court, is a civil court of the United Nations that adjudicates disputes between countries. This differs from the International Criminal Court (ICC), which tries individuals for war crimes. As members of the United Nations, both South Africa and Israel are bound by this tribunal.
South African President Cyril Ramaphosa once compared Israel’s policies in Gaza and the occupied West Bank to the previous apartheid regime that implemented racial segregation imposed by a white minority government that ended in 1994.
Many parties agree on this. Some human rights organizations say Israel’s policies towards the Palestinians amount to apartheid.
