Sentences of Imran Khan, Bushra Bibi suspended in Tosha Khana case

The Islamabad High Court on Monday ordered the release of former Prime Minister Imran Khan and his wife Bushra Bibi in the Tosha Khana case while suspending their sentences.

Now the court will hear this case after Eid.

Despite the suspension of sentence in the Tosha Khana case, Imran Khan’s release is not possible because there are many other cases pending against him in some of which he has been sentenced.

A two-member bench headed by Islamabad High Court Chief Justice Amir Faureq passed the verdict after hearing the suspension of sentences awarded to Imran Khan and his wife by the accountability court.

On January 31 this year, the accountability court sentenced Imran Khan and his wife to 14 years in prison and fined 14 years in the Tosha Khana case, while disqualifying Imran Khan for 10 years from holding any public office.

Tehreek-e-Insaf’s position

Tehreek-e-Insaaf said in a statement that the trial court had not only compromised the transparency of the trial by giving limited access to the lawyers, but the verdict had been delivered in haste without allowing the defense to complete its arguments. The statement said that PTI is confident that the High Courts will now quash the convictions after hearing the case.

What was the Tosha Khana disqualification reference decision?

On October 21, a five-member bench of the Election Commission had pronounced the Tosha Khana disqualification reference against Imran Khan, stating that the Tehreek-e-Insaf chairman had deliberately violated the Election Act 2017.

The Election Commission had disqualified Imran Khan under Article 63 (one) (p) for submitting a false statement.

The verdict said that Imran Khan had submitted a false statement, violating Section 137 (submission of details of assets and liabilities), Section 167 (corrupt practice) and Section 173 (submission of false statement and declaration) of the Election Act 2017. is, and thus they are guilty of corrupt practice under the relevant sections of the Election Act.

The judgment further said that Imran Khan deliberately concealed the facts by not declaring the gifts received from Tosha Khana in assets.

The Election Commission of Pakistan had recommended criminal action against Imran Khan in the decision.

Who filed the Tosha Khana reference?

On August 4 last year, Pakistan Muslim League-N leader Mohsin Nawaz Ranjha approached the Speaker of the National Assembly for not sharing the details of the Tosha Khana case against Imran Khan with the signatures of the legal experts of the ruling alliance Pakistan Democratic Movement (PDM). A reference was filed under Articles 62 and 63 of the Constitution of Pakistan.

The reference also alleged that government gifts were sold abroad, while all the documentary evidence was also submitted along with the reference.
