The Administrative Control Authority had appealed before the judiciary the Council of Ministers’ Resolution No. 103 of 2022 appointing Muhammad bin Kathir as head of the Authority and its Resolution No. 280 establishing the Commercial Registry Authority, which requires, according to Article 50 of the Control Law, a suspension of implementation of the appealed decision until a final ruling is issued.
The Director of the Legal Affairs Department in the Council of Ministers had informed the Ministry of the appeal, which in turn notified the Commercial Registry Authority and its director that the Authority was non-existent and that Bin Katheer had no standing. However, he clung to the contested position and continued to issue commercial records by pressuring Ahmed Suleiman, Director of the Local Commercial Registry, Tripoli, who It occupies the same department building in Janzour.
It is worth noting that Ben Katheer was appointed to the Ministry of Economy in 2015 at the seventh rank and was named head of the department in 2022. This is a position with a job grade of 14 and equivalent to the rank of Undersecretary of the Ministry.
