Its objective was to explain that President Gustavo Petro has the power to convene a national constituent assembly through the peace agreement with the FARC guerrilla.

Initially, before several media outlets, the lawyer also mentioned: “The peace agreements, being part of the constitutional block, have preeminence in the internal order and are considered legal norms,” ​​he emphasized.

Furthermore, Montealegre pointed out during the meeting that, in accordance with what was stipulated in Havana, specifically in the introduction of the special agreement, it is clearly established that the The Colombian State is obliged to convene a national agreement.

The former Attorney General of the Nation stressed that the concept of “national agreement” implies the convocation of a national constituent assembly. Furthermore, he emphasized that once this process has begun, it will be subject to review by the Constitutional Court.

“The president can develop it directly through an autonomous constitutional regulation. This would imply that once the Constituent Assembly is called by the president, as the regulation has force of law and it is law, it has to go to the control of the Constitutional Court to determine whether it is enforceable or not.”he indicated.

Finally, Montealegre pointed out that the expression “national agreement” in the introduction of the peace agreement could imply the convocation of a Constituent Assembly. He stressed that, although this provision does not constitute a law in itself, it has great weight and can influence the way legislation is legislated in Colombia.
