Successful actress Ezgi Mola was fined in the ‘insult’ case against Musa Orhan (26), in whose letter İpek Er (18), who committed suicide in Batman, wrote that he had sexually assaulted her.
TWO CASES AGAINST EZGİ MOLA
İpek Er, who attempted suicide with a gun in Beşiri district and died in the hospital 34 days later on August 18, 2020, wrote in the letter she left, claiming that Specialist Sergeant Musa Orhan, who was on duty in Siirt, sexually assaulted her. A lawsuit was filed against Orhan at the Siirt 1st High Criminal Court, demanding a prison sentence of not less than 12 years for the crime of ‘qualified sexual assault’. While the trial of the detained defendant Orhan was continuing, reactions poured in on social media. Actress Ezgi Mola also shared a post on her social media account on August 20, 2020. Musa Orhan’s lawyer, Mehmet Erkan Akkuş, filed a criminal complaint with the Ankara Chief Public Prosecutor’s Office regarding Ezgi Mola’s post. Following the investigation, a lawsuit was filed against Mola for ‘insulting through a voice, written or video message’, demanding a prison sentence of up to 2 years and 4 months.
WILL PAY 10 THOUSAND TL COMPENSATION
With the decision made by the Ankara 31st Criminal Court of First Instance on May 24, 2022, Ezgi Mola was sentenced to a judicial fine of 6 thousand 960 TL for 87 days on the grounds that she committed the crime of ‘insult’. In addition, Musa Orhan’s lawyer, Mehmet Erkan Akkuş, filed a lawsuit against Mola for non-pecuniary damages. The decision was made today in the case heard at the Banaz Civil Court of First Instance. He ruled that Ezgi Mola should pay 10 thousand TL, including legal interest as of August 20, 2020.
“INSULTING BY TWEETING IS NOT FREEDOM OF THOUGHT”
Lawyer Mehmet Erkan Akkuş said, “No matter who it is done to. Insulting or lynching by tweeting is not constitutional freedom of thought. The presumption of innocence and the right to a fair trial are sacred values that we all need, must be protected, and cannot be used as an appetizer to populism. This decision is a precedent.”
