He Public ministry (MP) spoke out regarding the complaint and request for withdrawal of immunity presented this Thursday, February 29, against the attorney general, Consuelo Porras. The action was promoted by the General Secretariat of the Presidency of the Republic and the Attorney General’s Office (PGN) for the possible commission of the crime of breach of duties.
The heads of the aforementioned entities went to the Court Tower in the morning, where they stated that an analysis was carried out and it was decided to take legal action “in response to Porras’ refusal” to attend to the call made by the ruler Bernardo Arévalo to participate. at the cabinet meeting on January 29.

On that occasion, the prosecutor went to the Presidential House, but only remained there for between 10 and 15 minutes, as she later left arguing that there was a legal impediment to her participation in the meeting.
In this regard, the Department of Information and Press of the investigating entity indicated that Porras’ decision is duly based on what is established by law, which is why it is considered that the request for the withdrawal of pre-trial lacks legal basis.
“Being spurious and with a possible political origin in order to obstruct justice and hinder criminal action. Therefore, the Public Ministry will act in accordance with its legal and constitutional mandate,” the office stated.

MP presents legal argument
The MP explained the legal arguments that would support Porras’ withdrawal from the meeting called by Arévalo. He pointed out that, in compliance with article 4 of the Organic Law of the institution, he attended the Presidential House, “with the desire to establish a constructive dialogue in favor of the people of Guatemala.”
However, he assured that the president began a meeting of the Council of Ministers, when the Political Constitution of the Republic and the Law of the Executive Branch establish that this body cannot be made up of people other than what the law dictates.
In that sense, it was indicated that Porras recorded the legal irregularity, since it was indicated that he only has the obligation to go to a specific cabinet, made up of ministers and for the purposes established in a government agreement that gives it life, which did not occur on that occasion.
