Legal notices have been sent to the concerned to close primary and secondary schools throughout the entire month of Ramzan. Supreme Court lawyer Md. sent this notice to the Secretary of the Ministry of Primary and Mass Education, the Secretary of the Ministry of Secondary and Higher Education. Elias Ali Mandal.
The notice sent by registry post on Sunday (February 18) said that 98 percent of the citizens of Bangladesh are Muslims. According to the Constitution 2A ‘the state religion of the Republic is Islam’ and Article 31 nothing can be done except by law. Article 152(1) Law means ‘any custom and custom having the force of law in Bangladesh’ Since the independence of Bangladesh, educational institutions are closed during the month of Ramadan, this is the legal custom and principle and thus all educational institutions are closed during the month of Ramadan. Therefore, the controversial decision of the government to keep primary and secondary schools open during the month of Ramadan is unconstitutional.
It is also said that the decision was taken by the Ministry of Education on December 11 last year to close all the educational institutions in the country during the upcoming month of Ramadan, but the recent decision of the relevant authorities to keep the primary and secondary educational institutions open during the month of Ramadan is discriminatory and contradictory.
The notice also said that during the month of Ramadan, the teachers fast and teach in the class. So students are not focused on the subject. Besides, it will be difficult for parents to take their child to school after fasting. In this situation, I am requesting for the instruction not to keep the school open. So much physical and mental stress and torture on children by keeping schools open is inhumane. Since the independence of Bangladesh, schools and colleges used to be closed during the month of Ramadan. The current decision of the government is in conflict with Articles 26, 27, 28, 31 and 32 of the Constitution. Therefore, I am requesting to cancel that decision and close the school in the holy month of Ramadan.
After receiving this notice, primary and secondary schools have been requested to remain closed throughout the entire month of Ramzan. Otherwise, a writ will be filed seeking necessary instructions in this regard, the notice also informed.
