Supreme Decree 280-2023-EF explains the procedure that family members or representatives who seek to collect the contributions of a deceased ex-fonavista must follow. To this end, the DS indicates that duly accredited family members may make the payment through the Banco de la Nación, at the national level.

On the other hand, the decree also establishes an exclusive priority order, that is, the order in which the family members who can come to collect the amount assigned to the former contributor. The relationship is:

– The surviving spouse or member of the de facto union, minor children and children with permanent total disabilities accredited by Conadis

In the absence of the persons indicated above, the return corresponds to those who prove that they are debtors of the deceased Fonavista, through intestate or testamentary succession.

The law mentioned above also indicates the procedure that the relatives or relatives of deceased former taxpayers must follow to collect Refund 1 at the Banco de la Nación.

To do this, a sworn statement must be drawn up, indicating that the person presents themselves as a debtor of the deceased Fonavista and that they do not know other relatives or third parties of greater or equal priority than them.
