Kazakh citizens were awarded 100 thousand tenge for unsanitary conditions on the train

Two passengers of the Atyrau-Aktobe train filed a lawsuit against Passenger Transportation JSC due to unsanitary conditions, Liter.kz reports with reference to Range.

The carriage in which the plaintiffs were traveling was not ready for transportation. In their statement of claim, they spoke about the dust, and rusty and dirty water flowed from the tap. They called 102. Transport police arrived at Makat station and took the statement. Also, outraged by the unsanitary conditions, passengers asked to change their seat or carriage, but were refused. As a result, they demanded 500 thousand tenge from Passenger Transportation JSC for moral damages.

The representative of the railway company did not agree with such demands of the plaintiffs. He explained that they were cleaning the carriage, it was hot in Atyrau (it was still summer), so the windows of the carriages were open and dust could get inside through them.

In court, the plaintiffs proved by video that there were unsanitary conditions in the carriage. The court also noted that the defendant’s argument that dust could have entered the train through open windows was stated only to avoid liability to passengers.

The other day, the court decided that passengers outraged by unsanitary conditions were right in this dispute. The court ordered the defendant to pay two plaintiffs 50 thousand tenge each for moral damages.

Let us remind you that this is the second time that money has been collected from the railway company in favor of passengers for the lack of comfortable conditions in the carriages.
