IPS approves regulations that establish admission medical examination for insured persons

ASSUMPTION. The Board of Directors of the Social Security Institute (IPS) approved the regulations that establish the presentation of an admission medical examination for insured persons. It will be evaluated whether a worker is suitable or not suitable. The measure still does not have an implementation date, since regulations from the Ministry of Labor are needed.

Bettina Albertini, director of Interinstitutional Relations of the IPS, reported that the pension approved a regulation that establishes the admission exam for the institution. “This seeks to reduce occupational risks. We seek to expand our contributing capacity. We seek to honesty our database. The form will only say suitable or not suitable,” she said.

He explained that in this case the IPS seeks to comply with what the Labor Code currently says, in its article 275, regarding this admission requirement exam.

“The employer must arrange for the medical, admission and periodic examination of each worker, assuming the cost. The regulations will determine the time and manner in which periodic medical examinations must be carried out, which will be relevant to the risks involved in the worker’s activity,” the regulations state.

He indicated that the pension took the first step with the approval of the resolution and that the Ministry of Labor will be in charge of the regulations, regarding the scope, the way in which it will be applied and when it will come into force.

The director stated that she intends to know the health status of the potential employees; Although she rejected possible discrimination, she acknowledged that they seek to know who is “fit or not fit.”

“The intention is not to close the door to anyone. It is not because she is sick that she cannot enter the pension, but it must be seen that the person can work,” she noted.

“For example, a person in bed will not be able to work as a bus driver. If the person is sick, but if he can still work, the doors will be open,” she said, and clarified that this measure does not cover the beneficiaries of the contributors, but only the workers.
