People can transfer the title of a motorbike without the previous owner, similar to the steps following the procedure for “transferring vehicle title to vehicles that have transferred ownership through many organizations and individuals”.
According to the provisions of Article 31 of Circular 24/2023/TT-BCA, the steps to carry out procedures for transferring motorbike title without the previous owner are as follows:
Step 1: Carry out recovery procedures
The person using the vehicle goes to the agency managing the vehicle’s registration documents to complete the recall procedure. Then, declare the registration revocation declaration and vehicle license plate on the public service portal. Next, provide the online application code and submit the paper application along with the license plate and vehicle registration.
After confirming the documents are valid, the vehicle registration agency issues a certificate of revocation of vehicle registration and license plate.
In case the records management agency and the vehicle title transfer registration agency are the same, the person using the vehicle does not have to go through recovery procedures. Instead, just submit the vehicle registration certificate and license plate when completing title transfer procedures.
Step 2: Complete procedures to transfer motorbike title without the previous owner
The person using the vehicle must carry out procedures to transfer the vehicle’s title at the vehicle registration agency where he or she permanently or temporarily resides. The commune-level police of the place of residence will transfer the motorbike’s title. The district police of the place of residence will transfer the car’s title.
Vehicle title transfer documents include: Vehicle registration declaration (clearly stating the purchase and sale process and commitment to take responsibility for the vehicle’s legal origin), registration fee documents, registration revocation certificate, Vehicle license plate (with engine number and chassis number stamped with matching stamp of the vehicle registration agency).
Step 3: People who want to transfer vehicle title will receive an appointment letter within 30 days. Authorities will verify vehicle registration data.
Step 4: Receive vehicle title transfer results
After 30 days, if there are no disputes or complaints, the vehicle registration agency will issue a decision to sanction the act of not carrying out recovery procedures and resolving vehicle title transfer for the current vehicle user.
