Hindu Sena members reach High Court against Kejriwal, he should be immediately removed from the post of CM.

Delhi. Another petition has been filed in the Delhi High Court demanding the removal of Arvind Kejriwal from the post of Chief Minister. This new petition was filed on behalf of Vishnu Gupta of Hindu Sena. Earlier, the Delhi High Court had rejected the petition making a similar demand saying that there is no legal obligation that Kejriwal cannot remain the CM after being detained. The court had also commented that if there is any constitutional crisis then the LG or the President has to take a decision on it. There is no justification for the court’s interference in this. Arvind Kejriwal was arrested by the Enforcement Directorate on March 21 in the scam case related to Delhi Liquor Policy. After this, he was sent to ED custody till 28 March, which has been extended till 1 April.

In the petition, Hindu Sena has demanded the LG to issue an order to dismiss Kejriwal from the post of Chief Minister. Along with this, it should also be decided that the government of Delhi should be run by the Central Government through LG. It has been said in the petition that there is no such concept in the Constitution of the country that a Chief Minister can run the government from judicial or police custody in case of arrest.

The petition filed by Hindu Sena also mentions, “There is no such law that the courts should interfere in the constitutional provisions to ensure purity in administration and governance.” It has also been clarified in the petition what are the powers of a Governor under Articles 163 and 164 of the Constitution.
