Hermosilla, for the right to honor, seeks to close “Pandora’s box” and ensure that its chats are not known

In an unprecedented move, within the framework of the so-called Hermosilla Case, lawyer Mario Vargas filed a protection appeal with the aim of preventing the more than 770,000 pages of conversations extracted from the cell phone of lawyer Luis Hermosilla from reaching the hands of the Defense Council. of the State (CDE).

The protection appeal, presented before the Court of Appeals of Santiago, marks a milestone as it is the first of its kind aimed at preventing the delivery of this type of evidence to the CDE.

It is worth mentioning that, in a series of WhatsApp conversations, found by the Public Ministry on his iPhone 14 Max, lawyer Luis Hermosilla shows an interesting degree of influence in the appointments of ministers of the Judiciary. Furthermore, the revelation of a minimal part of Hermosilla’s chats culminated in the rapid defenestration of the former director of the PDI, Sergio Muñoz, and left him the only guest in the PDI cell in Cerrillos.

Vargas’ initiative arises in response to the statements of the president of the CDE, Raúl Letelier, who announced in CNN Chile the intention to request access to the Hermosilla chats, currently in the process of expertise by the Eastern Metropolitan Prosecutor’s Office. These conversations, described by the Minister of Justice, Luis Cordero, as a potential “Pandora’s box”, have generated concern in Hermosilla’s inner circle.

In the court document, Vargas argues that the delivery of the chats would constitute a violation of his constitutional guarantees, including the right to equality before the law, the inviolability of private communications, and his right to honor and privacy.

Mario Vargas, recognized as one of the criminal lawyers closest to Hermosilla, has expressed concern about the content of the private conversations and the potential impact on his professional reputation. In addition, he criticizes public statements about a “corruption network” made by figures such as government spokesperson, Camila Vallejo, and deputy Daniel Manoucheri.

The appeal also points to the prosecutor’s office, requesting information about possible leaks and the identity of the officials in charge of safeguarding the files obtained from Hermosilla’s cell phone.

The decision on the admission of the appeal and the ministers in charge of its resolution now rests with the Court of Appeals of Santiago. However, to date, the CDE has not made its request for access to the chats official, as verified by Cyprus. Uncertainty persists about the potential impact that this situation may have on the country’s judicial and political sphere.

The cases involving members of the Judiciary and the former director of the PDI are added to the revelation of the controversial audio record in which the lawyer Luis Hermosilla is involved in the payment of bribes to officials of the Internal Revenue Service (SII) and the Commission for the Financial Market (CMF).
