HCC: Three requests for interpretation of the October 14 decision

HCDDED – CENI. The files pending with the High Constitutional Court number 6. Half concern requests for interpretation of decision no. 10-HCC/D3 of October 14, 2025 concerning a request for resolution on an end to the political crisis. The president of the High Council for the Defense of Democracy and the Rule of Law, HCDDED, contacted Ambohidahy for the purposes of interpreting article 4 of the said decision according to which “The existing constitutional institutions and bodies continue to exercise their usual powers.” Same request from the president of the CENI who also asks the constitutional judge to interpret Consideration 9 of the decision, namely, “After the recognition by the High Constitutional Court of the vacancy of the Presidency of the Republic, the election of a new President of the Republic shall be carried out within a period of at least 30 days and 60 days at most, in accordance with the provisions of articles 46 and 47 of the Constitution.”

Andry Rajoelina. Under penalty of committing a denial of justice, the HCC is required to rule on the request of the president of the CENI but also on that filed by Andry Rajoelina’s lawyers for the purposes of interpreting the decision of October 10, 2025. The three other files are easier for the HCC to decide because they respectively concern a request for the reinstatement of Mara Donna within the National Assembly; a finding of a vacant seat following the death of Jean-Jacques Rabenirina and designation of his successor; and last but not leastthe referral to deputies Siteny Randrianasoloniaiko and others for the purpose of motion for definitive impediment of the President of the Republic. For this third file, the HCC will undoubtedly judge that there is no longer any need to rule since the vacancy of the post of President of the Republic has already been noted.
