NEW YORK (AP) — Harvey Weinstein’s lawyer said Saturday that the former movie mogul was hospitalized for a series of tests after his return to New York City following an appeals court ruling that overturned his conviction for 2020 violation.
Attorney Arthur Aidala said Weinstein was taken to Bellevue Hospital in Manhattan after his arrival Friday at the city’s jails.
“They examined him and sent him to Bellevue. He looks like he needs a lot of help, physically. He has many problems. He is undergoing all kinds of tests. It’s kind of a train wreck as far as his health goes,” Aidala said.
A message was sent to the hospital with no response Saturday. Messages seeking comment were also left at city and state correctional offices.
On Thursday, the New York Court of Appeals overturned his conviction after concluding that a trial judge allowed the jury to see and hear too much evidence unrelated to the charges he faced. He also overturned his 23-year prison sentence and ordered a new trial.
Prosecutors said they intend to retry him on charges that Weinstein forcibly performed oral sex on a film and television production assistant in 2006 and raped an aspiring actress in 2013.
Weinstein has long suffered from a number of conditions, including heart problems, diabetes, sleep apnea and eye problems.
Aidala said she spoke with him Friday afternoon after he moved from a state prison to New York City, less than 24 hours after the appeal ruling, which was released Thursday morning.
He said his client’s ailments are physical, adding that mentally he is “sharp as a tack. His feet are firmly planted on the ground.”
The attorney said it typically takes corrections officials and state prisons one to two weeks to arrange transportation for a prisoner.
“They didn’t treat him well. They refused to give him even a sip of water, food, nor did they allow him to go to the bathroom,” Aidala said. “He is a sickly 72-year-old man.”
Aidala said he was told that Bellevue doctors planned to run many tests on Weinstein before he can be returned to the Rikers Island jail complex.
The lawyer said he plans to meet with Weinstein on Monday. He added that he plans to tell a judge when Weinstein goes to court on Wednesday in Manhattan that there should be a new trial after Labor Day.
