Gustavo Petro celebrated the decision on the San Juan de Dios Hospital

The decision by Petro and his administration reflects a change in the vision of the future of San Juan de Dios. In November 2023, the president had issued a decree authorizing the Government to acquire the hospital and the Maternal and Child Institute, with the purpose of recovering them and transforming them into the San Juan de Dios University Hospital and Maternal and Child Hospital. This new special entity will seek to offer medium and high complexity health services, in addition to promoting research and training in the health sector.

The challenges of demand

Although the termination of the contract with Copasa is a significant step, the process is not without its challenges. Bogotá’s Central-Eastern Subred is now facing a 500 billion pesos lawsuit filed by the Spanish company. This lawsuit includes 70 billion pesos claimed as compensation, broken down into 30 billion for the costs of the process and 40 billion for lost profits.

The lawsuit poses a new obstacle in the hospital’s restoration process, further complicating the outlook for the Petro administration. The conflict has also been exacerbated by the intervention of the Ministry of Culture, which has prevented the demolition of the Central Tower, citing the need to preserve historical heritage.

This decision has generated a breach of contract and has led to a series of legal disputes. Gerson Bermont, Secretary of Health, has pointed out that, despite the fact that the lands of San Juan de Dios belong to the District Health Financial Fund and not to the Central East Subnetwork, the national government is expected to play a fundamental role in resolving the contractual problem.

The Gustavo Petro administration, with its focus on hospital recovery and renovation, has laid out an ambitious vision. However, lawsuits and legal conflicts could delay the process and complicate the implementation of the proposed plans. The creation of the San Juan de Dios University Hospital and Maternal and Child Hospital is a significant goal, but its success will depend on how the legal and financial challenges along the way are handled.
