Former minister’s lawsuit advances after rejection of the senator’s plea

In a new twist in the case that confronts the senator of the Socialist Party (PS) Fidel Espinoza with the former minister Giorgio Jackson of the Democratic Revolution (RD), the Court of Appeals of Valparaíso has rejected the “dilatory exception” presented by Espinoza before the lawsuit filed against him by Jackson.

The judicial action initiated by Jackson accuses Espinoza of insults and slander, related to statements made during the episode of the theft of computers from the Ministry of Social Development in July 2023, a portfolio that at that time was under the leadership of the RD militant. According to the lawsuit, Espinoza identified Jackson as the “leader of the gang” involved in the robbery.

Espinoza’s response, presented last week to the Court and sponsored by socialist lawyer Francisco Zúñiga, argued that the lawsuit lacked the necessary details to exercise his right to defense, noting that it was not clear what the specific defamatory acts were. they accused him.

However, as stated Third, the Minister of Justice Mario Gómez rejected the dilatory exception, arguing that Jackson’s claim met the necessary requirements of clarity and certainty, as established in the Code of Civil Procedure. Gómez highlighted that Jackson’s lawsuit precisely detailed the events reported and requested compensation for the damages caused.

Lawyer Miguel Schurmann, Jackson’s representative, expressed agreement with Minister Gómez’s resolution and stressed that now is the time for Senator Espinoza to answer the lawsuit. Schurmann emphasized the need for Espinoza to explain how his statements do not constitute an accusation of crimes, as he has repeatedly stated in the media.
