If you’re a foreigner seeking legal employment in the USA, applying for an Employment Authorization Document (EAD) is essential. The EAD permits employers to hire you and proves that you can legally work in the United States.

Who is Eligible for the EAD Work Permit?

If you meet any of the following criteria, then you should apply for an EAD:

  • You’ve already been authorized to work in the USA based on circumstances or immigration status, such as being a refugee, asylee or U Nonimmigrant traveler; and you need to prove your employment authorization to your employer.
  • You need to apply for employment authorization, such as filing for Form I-485, or Form I-589.
  • Your non-immigrant status allows you to be in the USA, but you cannot legally work without prior USCIS permission, such as F-1 or M-1 student visas.

How Much Does the EAD Permit Cost?

The total costs associated with applying for an EAD Permit are as follows:

  • Filing fee: US$410 (Fee exemption possible in certain circumstances)
  • Biometric services fee: $85

To apply for an EAD permit, you’ll need to submit an Application for Employment Authorization (Form I-765). Here’s what you need to do:

  • Read the form instructions.
  • Complete and sign your Form I-765.
  • Pay any applicable fees.
  • Provide all necessary documentation and supporting evidence.

Can You Work Without an EAD Permit?

It’s illegal to work in the USA without an EAD permit. Employers cannot legally hire you without it. Additionally, they may also require you to have a Social Security number (SSN). You should apply for both the EAD permit and SSN at the same time. Lack of the required permits and authorizations may lead to consequences such as deportation, being barred from re-entry to the USA for up to 10 years, and other complications in future visa and immigration application processes.
