“Zhoghovurd” daily writes: “Judge Gohar Kostanyan of the Court of First Instance of Ararat and Vayots Dzor Marzes issued a verdict on February 28 in the case of former RA Ambassador to Poland, Extraordinary Envoy and Minister Plenipotentiary, public figure Edgar Ghazaryan, against Rustam Bakoyan, a deputy of the National Assembly (NA) : The court obliged the latter to publicly apologize for the insulting remarks he made to Edgar Ghazaryan and pay compensation in the amount of 1 million drams.
The court ruled:
1. The claim of Edgar Ferdinandi Ghazaryan against Rustam Zurbayi Bakoyan, regarding the demands to oblige him to publicly apologize for the insult, publicly deny the information considered defamatory and pay compensation, was partially satisfied.
1.1. To oblige Rustam Zurbayi Bakoyan to publicly apologize to Edgar Ferdinandi Ghazaryan for his insulting expressions with the following text: “I, Rustam Zurbayi Bakoyans, apologize to Edgar Ferdinandi Ghazaryan: “You have no brain”, “explain to this brainless…”, “Mr. fool”, “You are not a child of your people”, “What can this fool explain?” “, “Animal”, “You are a misunderstanding”, “You are not old enough to answer the questions”, “Ms. Ghazaryan, they brought you here as a fool”, “You are too young, are you listening? you’re too young, boy,” for insulting expressions like, “Shut up, do it!”
1.2. Publish the text of the apology through the site that originally published the video containing offensive expressions (the official page of the RA National Assembly social site “Youtube.com” or the official page of the “Youtube.com” social site of “1in TV” news).
2. To confiscate AMD 1,000,000 from Rustam Zurbayi Bakoyan in favor of Edgar Ferdinandi Ghazaryan as compensation for non-material damage for the insult.
3. Reject the rest of the claim.
4. To confiscate AMD 200,000 from Rustam Zurbayi Bakoyan in favor of Edgar Ferdinandi Ghazaryan as the amount of a reasonable attorney’s fee.
5. To confiscate AMD 50,000 from Rustam Zurbayi Bakoyan in favor of Edgar Ferdinandi Ghazaryan, as the amount of the state duty paid in respect of the satisfied claim.
6. For the rest, consider the state tax issue resolved.
The judgment enters into legal force one month after its publication and can be appealed to the RA Civil Court of Appeals within the same period.
In case of voluntary non-fulfilment of the part of the decision, it will be fulfilled through the service providing enforcement at the debtor’s expense.
Let’s remind that Edgar Ghazaryan submitted the lawsuit against Rustam Bakoyan to the court on April 9 last year.
Applying to the Court, the plaintiff stated that in 2023 On April 4, an extraordinary session of the Standing Committee on Human Rights Protection and Public Affairs of the RA National Assembly was convened to discuss the issue of proposing a candidate to the National Assembly for the position of Human Rights Defender of the Republic of Armenia.
The meeting was initially defeated by the representatives of the “Civil Agreement” faction of the National Assembly. At the commission session, which was attended by both commission members and several dozen other deputies of the “Civil Agreement” faction of the National Assembly, the members of this faction obstructed Edgar Ferdinand, the candidate nominated by the “Armenia” and “I have honor” factions of the National Assembly for the position of Human Rights Defender. Ghazaryan’s speech, uttering provocative and offensive expressions in an obviously negative, mocking tone, combining them with sarcasm and laughter.
During the session, Oustam Zurbayi Bakoyan repeatedly addressed the petitioner with clearly negative, insulting tone, belittling the person in the society, extremely rude, inappropriate vocabulary for a deputy… Moreover, Bakoyan also uttered defamatory expressions regarding Edgar Ghazaryan, in particular: “Drugs you and You’re using people like you, brainless.”
Note that Rustam Bakoyan was not the only one that day. Artur Hovhannisyan, secretary of CP faction, also showed hooligan behavior.”
