The procedure for sending referrals for medical and social expertise examination for the purpose of disability assessment has changed.

Publika.az reports that Prime Minister Ali Asadov signed a relevant decision in this regard.

With the amendment, a new paragraph was added to the document.

According to the new paragraph, the Commission refuses to issue a referral if the basic conditions specified in paragraph 1.5 of this Regulation are not present, as well as if the person refuses to undergo the necessary diagnostic examinations in the cases provided for in paragraph 2.2 of this Regulation.

It should be noted that clause 1.5 provides the grounds for issuing a shipment:

1.5.1. despite the fact that the person has been in ambulatory or inpatient treatment for the same disease continuously for the last 6 (six) months or intermittently for the last 12 (twelve) months in total for more than 6 (six) months, the impaired body functions are not restored and the person cannot fully and effectively participate in the life of society presence of persistent physical, mental, mental or emotional impairments;

1.5.2. the presence of mental disorders and anatomical deficiencies, drug-resistant forms of tuberculosis, stage IV oncological diseases, stage V chronic kidney disease in a person (the referral is issued without waiting for the period specified in subsection 1.5.1 of this Regulation);

1.5.3. continuation of the violations, deficiencies and diseases mentioned in subsections 1.5.1 and 1.5.2 of this Regulation after the end of the disability period;

1.5.4. determining the percentage of loss of professional labor capacity;

1.5.5. According to the opinion of the Commission regarding the change in the health status of a person with a disability, the need for a medical and social expert examination.

Clause 2.2 states that the commission collects the person’s medical examinations, including extracts from the medical history, no later than 7 (seven) working days (in the cases specified in subsection 1.5.2 of this Rule, 5 (five) working days) from the application for referral, and the treatment examines the results. If the person is sent to a specialized medical institution for the purpose of clarifying the diagnosis, this period is additionally increased up to 10 (ten) working days.
