The Plenary of Congress of Deputies will debate this Thursday, June 13, an amendment of all VOX to the Popular Legislative Initiative (ILP) for the extraordinary regularization of more than 500,000 immigrants. The training led by Santiago Abascal wants to prevent foreigners from obtaining papers who have illegally accessed Spanish territory and force his expulsion.
This is a complete amendment with alternative text, since, being an ILP already admitted by the Plenary on April 9, VOX He could no longer limit himself to asking for the return of the text. Specifically, VOX points out in the explanatory memorandum that «Foreigners who have illegally accessed Spanish territory may not be subject to regularization in any case.«.
Likewise, he proposes the «mandatory expulsion, not optional«, of all migrants who have entered Spain illegally. In addition, he also wants them to be expelled when they carry out conduct classified as serious or very serious.
Along these same lines, the training proposes to reform the Immigration Law and to carry out the expulsion of “legal” foreigners who commit crimes, even if they are punished with a custodial sentence of less than one year, and without the possibility of Cancellation of criminal records exempts from said expulsion. In this sense, it specifies that It will constitute cause for expulsion if the foreigner has been convicted inside or outside of Spain for malicious conduct that constitutes a crime.. If the sentence of conviction has been handed down outside of Spain, the expulsion will be carried out with the prior processing of the corresponding file.
Furthermore, he points out that the expulsion “will carry with it the prohibition of entry into Spanish territory«. Thus, the duration of the prohibition will be determined in consideration of the circumstances that arise in each case and its validity will be determined by the competent authority.
Loss of nationality
Likewise, VOX wants the Penal Code to be modified and those who are not of Spanish origin and who have committed crimes that are punishable with imprisonment equal to or greater than four years, or equal to or greater than one year in case of recidivism. «The foreigner naturalized in Spain who is sentenced, for the commission of a crime, to serving a custodial sentence equal to or greater than four years (or equal to or greater than one year, if he is a repeat offender), will be sentenced, in addition to the penalty assigned to him, to the loss of Spanish nationality«, he explains.
Finally, he wants to reform the Law on Cooperation for Sustainable Development and Global Solidaritywith the aim that collaboration in the fight against illegal immigration is a “necessary condition” for other nations to benefit from development aid from Spain.
The ILP admitted for processing on April 9 in the Congress of Deputies, with 310 votes in favor and 33 against VOX. The approval implies starting the parliamentary process of the text, which could be modified through the amendments presented by the parliamentary groups, which had until this Wednesday to present them. In any case, VOX has been the only one that has amended the initiative.
Specific, Up to 800 NGOs joined in the ‘Essentials’ project to claim extraordinary regularization of those foreigners in an irregular administrative situation who were residing in Spain before November 1, 2021.
