Congress must reject the interference of the IACHR

The former president of Congress Antero Flores-Araoz stated that the Inter-American Commission on Human rightsonce again interferes with the functions and decisions of the Peruvian Congress, exclusive and exclusive, such as making partial constitutional reforms, making modifications to state bodies, replacing the latter and even sanctioning laws.

Indeed, the Inter-American Commission has just expressed its concern, arguing that Congress has been acting against the “rule of law in the country” by attempting to replace the National Board of Justice (JNJ) with the National School of Judiciary and its questions to the Electoral System, improper and inexcusable interference, as well as his criticism of the disqualifications of some high-level public officials.

Congress cannot remain immobilized in the face of such aggression, which is why it is essential, not only to protest, but also in plenary to insist on the text observed by the Executive Branch for the creation of a very high-level Commission to make a diagnosis. of the Inter-American Human Rights System so that Peru requests from the General Assembly of the OAS the modifications that are appropriate to make the necessary corrective measures in the regulations of the Commission and the Inter-American Court of Human Rights.

The Law was approved in Parliament in December 2023, being observed by the President of the Republic and after the corresponding opinion due to insistence, until now it has not been put on the agenda of the Congressional Plenary nor is it debated, despite the fact that it is already halfway year since the initial text was approved.

A good response from Congress would be to insist on the initial text of that Law and approve it as soon as possible. The congressional masochism of standing with one’s arms crossed is a return to the old and already overcome bad habit of “the more you hit me, the more I love you,” ironically stated the former representative of Peru to the OAS, who in that administration initiated the negotiations to make substantial changes in the System that has unduly put our country in the pillory.
